Privacy policy

Privacy policy

Hūmen takes your privacy seriously. We therefore process only the data we need in order to provide and improve our services, and we handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes.

Scope and effective date

This privacy policy applies to the use of the website and the services offered on it by Hūmen. These terms took effect on 01/01/2023; when a new version is published, all previous versions cease to apply. This privacy policy describes which data about you we collect, what that data is used for, and with whom and under what conditions it may be shared with third parties. We also explain how we store your data, how we protect it against misuse, and which rights you have with regard to the personal data you provide to us.

If you have questions about our privacy policy, you can contact our contact person for privacy matters. You will find the contact details at the end of this policy.

About the data processing

Below you can read how we process your data, where we store it (or have it stored), which security measures we use and who has access to the data.

Webshop software

Shopify

Our webshop is built with software from Shopify. Personal data that you make available to us for our services is shared with this party. Shopify has access to your data in order to provide us with (technical) support; they will never use your data for any other purpose. Under the agreement we have concluded with them, Shopify is obliged to take appropriate security measures. Shopify uses cookies to collect technical information about your use of the software; no personal data is collected or stored.

Shopify Payments

To handle (part of) the payments in our webshop we use the Shopify platform. Shopify processes your name, address and place of residence and your payment details such as your bank account or credit card number. Shopify has taken appropriate technical and organisational measures to protect your personal data. Shopify reserves the right to use your data to improve its service further and, in that context, to share (anonymised) data with third parties. In the case of an application for deferred payment (a credit facility), Shopify shares personal data and information about your financial position with credit rating agencies. All the safeguards mentioned above regarding the protection of your personal data also apply to the parts of Shopify's service for which they engage third parties. Shopify does not keep your data longer than the statutory periods allow.

Reviews

Judge.me

We collect reviews through the Judge.me platform. If you leave a review via Judge.me, you are required to provide your name, place of residence and email address. Judge.me shares this data with us so that we can link the review to your order. Judge.me also publishes your name and place of residence on its own website. In some cases Judge.me may contact you to ask you to explain your review. If we invite you to leave a review, we share your name and email address with Judge.me. They use this data solely to invite you to leave a review. Judge.me has taken appropriate technical and organisational measures to protect your personal data. Judge.me reserves the right to engage third parties in order to provide its service, for which we have given Judge.me permission. All the safeguards mentioned above regarding the protection of your personal data also apply to the parts of the service for which Judge.me engages third parties.

Shipping and logistics

PostNL

When you place an order with us, it is our job to have your parcel delivered to you. We use the services of PostNL to carry out deliveries. For that reason it is necessary that we share your name, address and place of residence with PostNL. PostNL uses this data only to perform the agreement. If PostNL engages subcontractors, PostNL also makes your data available to those parties.

DHL

When you place an order with us, it is our job to have your parcel delivered to you. We use the services of DHL to carry out deliveries. For that reason it is necessary that we share your name, address and place of residence with DHL. DHL uses this data only to perform the agreement. If DHL engages subcontractors, DHL also makes your data available to those parties.

External sales channels

Bol.com

We sell (some of) our products through the Bol.com platform. If you place an order through this platform, Bol.com shares your order and personal data with us. We use this data to handle your order. We treat your data confidentially and have taken appropriate technical and organisational measures to protect it against loss and unauthorised use.

Purpose of the data processing

General purpose of the processing

We use your data solely for the purpose of our services. This means that the purpose of the processing is always directly related to the order you place. We do not use your data for (targeted) marketing. If you share data with us and we use that data to contact you at a later time, other than at your request, we will ask for your explicit permission. Your data is not shared with third parties, other than to meet accounting and other administrative obligations. All these third parties are bound to confidentiality on the basis of the agreement between them and us, or an oath or statutory obligation.

Your data

Automatically collected data

Data that is collected automatically by our website is processed with the aim of improving our service further. This data (for example your IP address, web browser and operating system) is not personal data.

Retention periods

We keep your data for as long as you are a customer of ours. This means we keep your customer profile until you tell us that you no longer wish to use our services. If you tell us this, we will also treat it as a request to be forgotten. Under applicable administrative obligations we have to keep invoices containing your (personal) data, so we will keep that data for as long as the applicable period runs. Our staff, however, will no longer have access to your customer profile or to documents we produced in connection with your order.

Your rights

Under applicable Dutch and European law, you as a data subject have certain rights regarding the personal data processed by us or on our behalf. Below we explain what those rights are and how you can invoke them. In principle, to prevent misuse, we send transcripts and copies of your data only to the email address already known to us. If you wish to receive the data at a different email address or, for example, by post, we will ask you to identify yourself. We keep a record of the requests we handle; in the case of a request to be forgotten we record anonymised data. You receive all transcripts and copies of data in the machine-readable format we use within our systems. You always have the right to lodge a complaint with the Dutch Data Protection Authority if you suspect that we are using your personal data incorrectly.

Right of access

You always have the right to inspect the data that we process (or have processed) that relates to you or can be traced back to you. You can send a request to that effect to our contact person for privacy matters. You will then receive a response to your request within 30 days. If your request is granted, we will send a copy of all data to the email address known to us, together with an overview of the processors that hold this data, stating the category under which we have stored it.

Right to rectification

You always have the right to have the data that we process (or have processed) that relates to you or can be traced back to you corrected. You can send a request to that effect to our contact person for privacy matters. You will then receive a response to your request within 30 days. If your request is granted, we will send a confirmation that the data has been amended to the email address known to us.

Right to restriction of processing

You always have the right to restrict the data that we process (or have processed) that relates to you or can be traced back to you. You can send a request to that effect to our contact person for privacy matters. You will then receive a response to your request within 30 days. If your request is granted, we will send a confirmation to the email address known to us that the data will no longer be processed until you lift the restriction.

Right to data portability

You always have the right to have the data that we process (or have processed) that relates to you or can be traced back to you handled by another party. You can send a request to that effect to our contact person for privacy matters. You will then receive a response to your request within 30 days. If your request is granted, we will send transcripts or copies of all the data about you that we have processed, or that has been processed by other processors or third parties on our behalf, to the email address known to us. In all likelihood we will not be able to continue our service in such a case, because the secure linking of data files can then no longer be guaranteed.

Right to object and other rights

In some cases you have the right to object to the processing of your personal data by or on behalf of Hūmen. If you object, we will immediately cease processing the data pending the handling of your objection. If your objection is justified, we will make transcripts and/or copies of data that we process (or have processed) available to you and then cease processing permanently. You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in a way that makes this right applicable. If you believe that we do, please contact our contact person for privacy matters.

Cookies

Google Analytics

Cookies from the American company Google are placed through our website as part of the Analytics service. We use this service to track and receive reports on how visitors use the website. This processor may be obliged under applicable law and regulations to give access to this data. We collect information about your browsing behaviour and share this data with Google. Google can interpret this information in combination with other data sets and in that way follow your movements on the internet. Google uses this information to offer targeted advertising and other Google services and products, among other things.

Third-party cookies

If software solutions from third parties use cookies, this is stated in this privacy statement.

Changes to this privacy policy

We reserve the right to change our privacy policy at any time. You will, however, always find the most recent version on this page.
